1. Introduction

This Privacy Policy describes the information processing practices of 365 DataSolutions ("365", “we”, “our”, or “us”) on the publicsearchesnow.com website. The Site is a web-based property of 365 DataSolutions that enables end-user visitors to the Site ("Visitors") to conduct searches of our databases of publicly available sources of information about individuals. This Privacy Policy describes the ways in which 365 collects, uses, and discloses information about you when you access the Site. By accessing, viewing, downloading, or otherwise using the Site, you consent to the collection, use, and disclosure of your information as set forth in this Privacy Policy, now and as amended or modified by us.

This Privacy Policy is incorporated into and subject to our Terms of Use (“Terms”). By clicking your acceptance of this Privacy Policy and Terms of Use during the initial access of our Site you are entering into a legally binding agreement with 365 based upon the terms of these policies. I. Types of Information Collected

We collect a number of different types of information about you (collectively, “Personal Information”):

A. User Information Submitted: User Information is the information we collect from you when you submit an online application to become a 365 member which allows you to utilize services through the Site; when you submit a request to opt out of our People Search results; when you conduct a Background check; or when you contact us with any question, comments, or request. User Information may include, but is not limited to: (1) Contact Data (such as your name, mailing address, and e-mail address); (2) Financial Data (such as your account or credit card number); and (3) Demographic Data (such as your zip code and age).

B. Traffic Data: We may automatically track and collect the following categories of Traffic Data when you visit our Site: (1) Event Data, which includes: (i) Internet Protocol ("IP") address, (ii) access times, (iii) browser type and language, (iv) Internet Service Provider ("ISP"), (v) the pages you visit on our Site, (vi) the Content you view on our Site, and (vii) the URL of the page that referred you to our website; (2) domain servers; and (3) types of devices you use to access the Site. Traffic Data also includes data collected from Cookies.

When you visit the Site, we or our third-party service providers may use a “Cookie” — a small, text-only file that we save to your hard drive — or similar technologies to automatically collect and store non-personally-identifiable information about your usage of the Site such as your IP address, your browser type, the links and items you click on, ad impressions on your web browser, and the web pages you visit. 3. Confidentiality and Security of Personal Information

I. User Ability to Access, Update, and Correct Personal Information

If the information you submit to us changes, or if you no longer desire our services, you may correct, update, or request deletion of this information by making the change on your account information page or by contacting us at the contact information listed below. In the case that your credit card, user name, or password is lost, stolen, or used without permission, promptly contact us at support@publicsearchesnow.com to update the Personal Information we have on file for you.

If you wish to deactivate your account, please email us at support@publicsearchesnow.com, but note that we may retain cached or archived copies of your information as required by law or for legitimate business purposes. We may still retain certain information associated with your account for recordkeeping integrity, as well as to prevent fraud, resolve disputes, enforce our Terms of Use or other policies, take actions we deem necessary due to technical and legal requirements and constraints related to the security, integrity and operation of our Site.

With regard to content on our Site, upon request we can block the records we have control over in our database from being shown on 365. You can request for your personal information to be blocked from being searched using the link below. Unless otherwise required by law, we will only accept such requests directly from the individual whose information is being opted out, or from a registered authorized agent, and we reserve the right to require verification of identity and may reject opt-out requests except as prohibited by applicable law. We may need you to provide additional information to verify your request, such as providing data elements so that we can confirm they match the information already maintained by us. We will not use this additional information for anything other than handling your request. We do not accept content removal requests via fax or postal mail. Please note that changes you request may not be effective immediately. Note that despite any request for removal of or change to personal information, we may need to retain certain information for recordkeeping purposes and there may also be residual information that will remain within our databases and other records, which will not be removed or changed.

365 uses reasonable security measures to protect against the loss, misuse, and alteration of the information under the control of 365. However, no data transmission over the Internet, wireless transmission or electronic storage of information can be guaranteed to be 100% secure, and to the maximum extent permitted by law, we do not accept liability for any unauthorized disclosure of your information.

III. User Ability to Download/Suppress Publicly Available Information

We may share your Publicly Available Information with other users of our Site when they search for you. 4. Updates and Changes to Privacy Policy

We may update or modify this Privacy Policy by posting such update or modification on the Site, or by other means as required under applicable law. Any such change, update, or modification will be effective immediately upon posting on the Site. If you do not agree to the new changes, please stop using the Site.

5. Children's Information

The Site is not directed to children under 13 (or other age as required for data processing under applicable law), and we do not knowingly collect Personal Information from children. If you are a parent or guardian and believe your child has uploaded Personal Information to our Site without your consent, you may contact us as described in Contact Information below. If we become aware that a child has provided us with Personal Information in violation of applicable law, we will delete any Personal Information we have collected, unless we have a legal obligation to keep it, and terminate the child's account if applicable.

6. Children's Privacy

The Site is intended for a general audience and is not directed or intended for children under 18 years of age. We do not knowingly collect personal information from individuals under 18 years of age. If you are under 18 years of age, you may not register or provide personal information on the Site. If we later obtain actual knowledge that a user is under 18 years of age, we will remove that user's personal information from our systems.

III. Third Party Use of Personal Information

In the preceding twelve (12) months, 365 has utilized third parties as follows:

Advertising and Analytics Data Collection: 365 and third parties use first-party cookies and identifiers to recognize you, customize a tailored experience, and provide advertisement on the Site. Tracking data collected by these advertisers and third parties is used to decide which ads you see both on our Site and on third-party sites and applications, but is not associated with your registration account. We do not have access to or control over information that may be collected by advertisers and third parties, but many ad networks, data exchanges, marketing analytics and other service providers may allow you to choose not to receive their targeted advertising.

Payment/Transactions: We use third parties to help with operations of our business, the Site, or administrative activities on our behalf such as processing payment. We may share your information with these third parties for those limited purposes.

Third Party Integrations: If you sign up for, or log into, our Site using a third party service such as Facebook or Google, or link your account with us to your account with a third party service such as Facebook or Google, we may receive information about you from such third party service, such as your name and email address. If you post content to a third party service through the Site, that third party service will also receive that content, which will be visible to anyone that has access to it through that third party service.

To Know and Access: to obtain a copy of the specific pieces of Personal Information we have collected about you. Deletion: to request that 365 delete your Personal Information. This right may be limited to the extent that 365 is permitted or required by applicable law to retain information. If you request deletion of your Personal Information, you may no longer be able to use or access the Site. If you decide to use or access the Site again, 365 may consider this a new account, and may collect Personal Information associated with that account in accordance with this Privacy Policy.
Opt-Out of “Sale” and Certain Sharing Practices: you have the right to opt out of certain information sharing practices with third parties who do not act as our service providers. In some states, like California, this information sharing may qualify as a “share” or a “sale,” while in other states, like Virginia, this information sharing may qualify as “targeted advertising” (collectively, “personalized advertising”). A. Verification and Appeal Process: We are required by law to take reasonable steps to verify your identity prior to responding to your request. Please note that your exercise of these rights is subject to certain exemptions to safeguard the public interest (e.g., the prevention or detection of crime) and our interests (e.g., the maintenance of legal privilege). If we are unable to process your request via you authenticating yourself on the Site, we may verify your request by asking for information sufficient to confirm your identity, such as your name, email address, and phone number. Requests to exercise these rights may be granted in whole, in part, or not at all, depending on the scope and nature of the request and as permitted by applicable law. Where required by applicable law, we will notify you if we reject your request, and notify you of the reasons we are unable to honor your request.

If you are a resident of Colorado, Virginia, Connecticut, Texas, Delaware, or Oregon, you have the right to appeal a request we deny when we have verified your identity and still decline to honor your request. The process for that appeal will be sent to you separately if your request is denied.

B. Authorized Agent: Depending on where you live, you may have the right to use an authorized agent on your behalf to exercise a privacy right discussed above. Please note that before completing any requests, and in addition to our identification verification process, we are required to verify that your agent has been properly authorized to request information on your behalf and this may take additional time to fulfill your request.

If you are an authorized agent trying to exercise rights on behalf of a 365 user, then you can either (i) make a request on the user's behalf by contacting us as set forth below in the “Contact Information” section and such requests must include a written authorization from the consumer that includes the consumer's full name, address, telephone number and valid email address used by the consumer to interact with 365 that is signed by the consumer and clearly bestows upon the agent the proper authority; or (ii) an acting agent can provide a valid power of attorney signed by the consumer on the agent's behalf and a valid email address used by the consumer to interact with 365. In addition, for a request under the Right to Know, Right to Delete, or Right to Correct, the email address of the consumer will be used to separately verify the agent's authority directly with the consumer.

C. “Do Not Track” / “Global Privacy Control”: Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Additionally, some browsers or plug-ins use a “Global Privacy Control” (“GPC”), which you can learn more about at Global Privacy Control — Take Control Of Your Privacy. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers. However, if our Site detects a GPC signal from your device, we will interpret it as either a Do Not Sell request or a request to limit the sale or sharing of personal information for targeted advertising depending on the law applicable to your jurisdiction.
